New Immigration Rules to correct errors in the July 2012 changes.

The government introduced new Immigration Rules on 05/09/12 [HC 565]. The rules have been made to correct the Immigration Rules that were introduced in July.

The rules are also an attempt to respond to the decision in “Alvi” which came out soon after the July changes and stated that any requirement which, if not satisfied, would lead to an application being refused had to be contained in the Immigration Rules and the Government could not rely upon policy guidance to make changes to the Immigration Rules.

It is therefore important to check on the UKBA website for the current version of the Immigration Rules.
